1. Supreme Court: non-party can appeal consent decree with leave of court
The Supreme Court held that a non-party can appeal a consent decree with the leave of the appellate court if the decree prejudicially affects a legally cognisable interest. A Bench of Justices J.B. Pardiwala and K. Vinod Chandran upheld a Gujarat High Court order granting nine HUF members leave to appeal against a 2013 consent decree. The court held that Section 96(3) and Order XXIII Rules 3 and 3A of the Code of Civil Procedure, 1908 do not bar a stranger to a compromise from seeking leave. The judgment, authored by Justice Pardiwala, dismissed the appeals of Girishbhai Natwarlal Patel.
Why it matters for exams: This judgment is important for Polity and Judiciary topics, covering the Code of Civil Procedure provisions, the rights of non-parties and the powers of the Supreme Court.
